These Terms and Conditions ("Terms") govern the use of the services offered under the name India Care Desk, operated by Kim Piessen Zorg, a company incorporated in the Netherlands.
By purchasing a membership, accessing the website, or using any service of India Care Desk, you confirm that you have read, understood, and agree to be legally bound by these Terms.
1. Legal Entity & Applicability

These Terms apply to all individuals who purchase a membership or otherwise use the services of India Care Desk (“Clients”).
2. Definitions

India Care Desk: A non-clinical medical concierge and coordination service.

Client: Any individual who purchases or uses a membership or services of India Care Desk.

Medical Provider: Any hospital, clinic, diagnostic centre, doctor, ambulance service, or healthcare professional.
-
Services: Non-medical concierge, coordination, and administrative services as described in these Terms.
For the avoidance of doubt, Clients are not patients of India Care Desk.
3. Nature of Services (Non-Clinical Concierge Only)
India Care Desk operates strictly as a non-clinical medical concierge and coordination service.
The Services are limited to:

Providing Clients in India with addresses and location details of medical facilities located in Tier-1 Indian cities and accredited by the National Accreditation Board for Hospitals & Healthcare Providers (NABH), based on publicly available information.

Coordinating contact between Clients and local emergency services or healthcare providers in Tier-1 Indian cities, where reasonably possible.

Coordinating pre-planned diagnostic appointments in India when arranged prior to the Client’s departure.
India Care Desk acts exclusively as an administrative and coordination intermediary between Clients and third-party Medical Providers.
India Care Desk does not:

Provide medical advice, diagnosis, treatment, or medical opinions
-
Interpret medical reports or test results
-
Recommend, endorse, or rank Medical Providers

Make treatment decisions
-
Guarantee availability, outcomes, or quality of medical services
All medical services are provided exclusively by independent Medical Providers.
4. No Medical Relationship & Medical Disclaimer
India Care Desk is not a medical provider and does not practice medicine or healthcare in any jurisdiction.
Any medical relationship exists solely between the Client and the chosen Medical Provider. India Care Desk has no control over, and accepts no responsibility for:

Medical decisions

Diagnostic accuracy
-
Treatment outcomes
-
Acts, omissions, or negligence of Medical Providers
Clients are advised to consult their own healthcare professionals before and after travel.
5. Independence of Medical Providers
All hospitals, clinics, diagnostic centres, doctors, ambulance services, and emergency responders are independent third parties.
India Care Desk does not employ, supervise, control, or direct any Medical Provider.
The inclusion, display, or identification of any Medical Provider does not constitute a recommendation, endorsement, or guarantee of quality, suitability, or outcome.
6. Use of Offshore Support Teams
India Care Desk may utilise internal personnel, affiliated entities, or contracted service providers located outside the European Union, including in India, to perform administrative, coordination, customer support, and operational assistance functions.
Such personnel and service providers:

Act strictly under the documented instructions of India Care Desk

Do not provide medical advice, clinical opinions, or independent services

Do not act as contractual counterparties to Clients
India Care Desk remains the sole contractual counterparty and retains full responsibility for the Services provided under these Terms.
7. Emergency Coordination Disclaimer
In the event of a medical emergency, India Care Desk may assist Clients by facilitating contact with local emergency services or healthcare providers.
Emergency coordination is provided on a reasonable assistance only basis. India Care Desk:

Is not an emergency responder

Does not control response times
-
Does not guarantee availability, response, or outcomes
Clients remain responsible for seeking immediate medical attention when required.
8. Membership Plans & Commencement
Membership plans include:

Short Stay – 15 days
-
Extended Stay – 30 days
-
Annual – 365 days
Membership commences on the date of payment, irrespective of travel dates.
9. Payments & Refunds
India Care Desk does not collect or process payments on behalf of Medical Providers. All medical fees are paid directly by Clients to the relevant Medical Providers.
Clients who are citizens or residents of the Netherlands are entitled to a 14-day statutory right of withdrawal, provided that:

The Client has not travelled to India, and
-
No Services have been used
A written self-declaration by the Client shall be considered sufficient proof.
No refunds shall be issued after the expiry of the 14-day period or once any Services have been used.
10. Travel, Visa & Insurance Disclaimer
Clients are solely responsible for:

Visa applications

Flight bookings
-
Travel insurance
India Care Desk is not responsible for immigration decisions, denied entry, travel delays, cancellations, or related consequences.
11. Data Protection & Privacy
India Care Desk aims to comply with:

The EU General Data Protection Regulation (GDPR)

Applicable Indian data protection laws
Client correspondence is stored on Zoho servers located within the European Union. Operational communication may occur via telephone, WhatsApp, or VoIP services.
India Care Desk does not sell, share, or disclose Client data to third parties, except where legally required by competent authorities.

12. Client Conduct & Termination
India Care Desk reserves the right to suspend or terminate Services or memberships, without refund, if a Client:

Provides false, misleading, or incomplete information

Misuses the Services
-
Acts abusively, unlawfully, or in bad faith
13. Complaints & Dispute Resolution
Clients must submit complaints in writing and allow India Care Desk a reasonable opportunity to resolve the issue before initiating legal action.
A reasonable cooling-off period shall apply prior to escalation of disputes.
14. Limitation of Liability
To the maximum extent permitted by law:

India Care Desk’s total liability is strictly limited to the amount paid by the Client for the applicable membership plan.

India Care Desk shall not be liable for indirect, incidental, consequential, or special damages, including loss of income, emotional distress, medical complications, or loss of opportunity.

India Care Desk shall not be liable for acts, omissions, delays, errors, or outcomes caused by Medical Providers, emergency services, transport providers, telecommunications providers, or other third parties.
15. Force Majeure
India Care Desk shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, political unrest, regulatory actions, network failures, or acts of third parties.
16. Intellectual Property & Branding
Clients may not use the name, logo, trademarks, or branding of India Care Desk, nor represent any affiliation, without prior written
consent.
17. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.
18. Acceptance of Terms
These Terms are accepted by:

Selecting the acceptance checkbox during sign-up via Zoho Forms, and/or
-
Continued use of the Services
If you do not agree to these Terms, you must not use the Services of India Care Desk.
